കോടതി കയറ്റത്തിനുള്ള സൂചനകളും പരസ്പരമുള്ള ചെളി വാരിയെറിയലുകളും ചിക്കാഗോ കണ്‍വന്‍ഷനെ നിറം കെടുത്തുമെന്ന സാഹചര്യം തുടരുമ്പോള്‍ തന്നെ ഫോമയില്‍ പ്രശ്‌നങ്ങള്‍ രമ്യമായി പരിഹരിക്കാനും നീക്കം നടക്കുന്നു.
സ്റ്റാറ്റന്‍ ഐലന്‍ഡ് മലയാളി അസോസിയേഷന്റെ അംഗത്വ ചെക്ക് കിട്ടിയില്ലെന്ന സെക്രട്ടറിയുടെ റിപ്പോര്‍ട്ടില്‍ തുടങ്ങിയ വിവാദം അവസാനിപ്പിക്കാന്‍ സംഘടനാ നേത്രുത്വം സജീവമായി രംഗത്തിറങ്ങി. ചെക്ക് വാങ്ങി പ്രശ്നം തീര്‍ക്കാമെന്നാണു നേത്രുത്വത്തിന്റെ നിലപാട്.
എന്നാല്‍ മെയ് 12 എന്ന അവസന തീയതി വച്ച ശേഷം ഒരു സംഘടനക്കു വേണ്ടി അതു മാറ്റുന്നത് കോടതിയില്‍ ചോദ്യം ചെയ്യപ്പെട്ടേക്കാം. കേസിനെ ഭയപ്പെടേണ്ട കാര്യമില്ലെന്നു സ്റ്റാറ്റന്‍ ഐലന്‍ഡില്‍ നിന്നുള്ള ജനറല്‍ സെക്രട്ടറി സ്ഥാനാര്‍ഥി ജോസ് ഏബ്രഹാം പറയുകയും ചെയ്തു.
ഒരു പ്രശ്‌നവും ഇല്ലാതെ ഈ വിവാദം മറികടക്കുമെന്നു ഫോമാ പ്രസിഡന്റ് ബെന്നി വാച്ചാച്ചിറയും പറഞ്ഞു.
പുതുതായി ചെക്ക് വാങ്ങുന്നത് തങ്ങളെ ബാധിക്കുന്ന പ്രശ്‌നമല്ലെന്നു മുഖ്യ ഇലക്ഷന്‍ കമ്മീഷണര്‍ അനിയന്‍ ജോര്‍ജ് പറഞ്ഞു. ചെക്കും ഡെലിഗേറ്റ് ലിസ്റ്റുമൊക്കെ എക്‌സിക്യൂട്ടിവാണു തീരുമാനിക്കുന്നത്. അവര്‍ തരുന്ന ലിസ്റ്റ് അനുസരിച്ച്ഇലക്ഷന്‍ നടത്തുക മാത്രമാണു തങ്ങളുടെ ചുമതല. ചെക്ക് വീണ്ടും വാങ്ങി ഡെലിഗേറ്റ് ലിസ്റ്റ് പുതുതായി നല്കിയാലും ഇലക്ഷന്‍ കമ്മീഷനു അതു പ്രശ്‌നമല്ല.
അതേ സമയം അംഗത്വ ഫീസ് നല്കാന്‍ അവസാന തീയതി മെയ് 12 എന്നു ഭരണഘടനയിലോ നിയമത്തിലോ ഒന്നും പറയുന്നില്ലെന്നു ജോസ് ഏബ്രഹാമും അനുചരരും ചൂണ്ടിക്കാട്ടുന്നു. അത് സെക്രട്ടറിയുടെ സൗകര്യപ്രകാരം വച്ച ഒരു തീയതി മാത്രമാണ്. ഭരണഘടനയനുസരിച്ച് കണ്‍ വന്‍ഷന്റെ തലേന്നു ചെക്ക് കൊടുത്താലും മതി.
ഒക്ടോബറില്‍ അംഗത്വ ഫീസ് കൊടുക്കണമെന്നാണു ഭരണഘടന പറയുന്നത്.
ഭരണഘടന പ്രകാരം ഇലക്ഷനു 30 ദിവസത്തിനു മുന്‍പ് പത്രിക നല്കണം. ഇലക്ഷനു 25 ദിവസം മുന്‍പ് വരെ ഡെലിഗേറ്റ് ലിസ്റ്റില്‍ മാറ്റം വരുത്താം. ഇലക്ഷനു മുന്‍പ് അംഗത്വം പുതുക്കണമെന്നു ഭരണഘടനയില്‍ പറയുന്നതേയില്ല.
അതിനിടയില്‍ അംഗത്വത്തിനുള്ള ചെക്ക് കിട്ടിയില്ലെന്ന സെക്രട്ടറിയുടെ നിലപാടും ചോദ്യം ചെയ്യപ്പെട്ടു. ചെക്ക് കിട്ടിയിട്ടും കിട്ടിയില്ല എന്നു നുണ പറയുകയാണെന്നാണു ഒരു വിഭാഗത്തിന്റെ ആരോപണം. ജയസാധ്യതയുള്ള സ്ഥാനാര്‍ഥിക്കെതിരായ നീക്കമാണിതെന്നും അവര്‍ പറയുന്നു. ആശയ കുഴപ്പം സ്രുഷ്ടിക്കുകയായിരുന്നു ലക്ഷ്യമെന്നാണവരുടെ വാദം.
അംഗത്വ ഫീസ് ഇനി സ്വീകരിച്ചാല്‍ തന്റെ നിലപാട് എന്തായിരിക്കുമെന്ന് അപ്പോള്‍ തീരുമാനിക്കുമെന്ന് മെരിലാന്‍ഡില്‍ നിന്നുള്ള സെക്രട്ടറി സ്ഥാനാര്‍ഥി മാത്യു വര്‍ഗീസ് (ബിജു) പറഞ്ഞു. അംഗത്വ ചെക്ക് നല്കിയിട്ടില്ല എന്ന കാര്യം ഇലക്ഷന്‍ കമീഷന്റെ ശ്രദ്ധയില്‍ പെടുത്തിയിരുന്നു. അവരുടെ മറുപടിയൊന്നും കിട്ടിയിട്ടില്ല. അതിനു ശേഷം എങ്ങനെ പ്രതികരിക്കണമെന്നു തീരുമാനിക്കും.
എന്നാല്‍ ഭരണഘടനയില്‍ അംഗത്വം പുതുക്കുന്നതു സംബന്ധിച്ച് ഒരു പരാമര്‍ശവുമില്ലെന്നു ഭരണ ഘടനാ വിദഗ്ദര്‍ ചൂണ്ടിക്കാട്ടുന്നു. ഇലക്ഷന്‍ തീരുമാനിച്ച ശേഷം അതിനുള്ള വിജ്ഞാപനം സെക്രട്ടറി പുറപ്പെടുവിച്ചത് നാഷണല്‍ എക്‌സിക്യൂട്ടിവിന്റെ തീരുമാനമായിട്ടാണ്. അതില്‍ അംഗത്വം പുതുക്കാനുള്ള തീയതി പറഞ്ഞിരിക്കുന്നു. അന്നു അംഗത്വ ഫീസ് കിട്ടിയില്ലെങ്കില്‍ ഡെലിഗേറ്റ് ലിസ്റ്റ് അംഗീകരിക്കില്ലെന്നും വ്യക്തമായി പറയുന്നുണ്ട്.
എല്ലാ സംഘടനകളും ഇതു പാലിച്ചിരിക്കെ ഒരു സംഘടനക്കു വേണ്ടി ചട്ടം മറ്റണമെന്നു പറയുന്നത് ശരിയല്ല. സ്റ്റാറ്റന്‍ ഐലന്‍ഡ് അസോസിയേഷന്‍ കണ്‍വന്‍ഷനില്‍ പങ്കെടുക്കട്ടെ, ഡെലിഗേറ്റുകള്‍ക്ക് അടുത്ത തവണ വോട്ടു ചെയ്യാം. ജോസ് ഏബ്രഹാമിനു വേണ്ടി സംഘടനാ നിയമങ്ങല്‍ കാറ്റില്‍ പറത്താനാവില്ല-അവര്‍ ചൂണ്ടിക്കട്ടുന്നു. അങ്ങനെ വന്നാല്‍ അത് കോടതിയിലെ അവസാനിക്കൂ എന്നും അവര്‍ മുന്നറിയിപ്പു നല്‍കുന്നു.
അതിനു പുറമെ സെക്രട്ടറിയെ ആക്ഷേപിക്കുകയും ഒറ്റപ്പെടുത്തുകയും ചെയ്യുന്നതും ശരിയല്ലെന്നും പൊതുവെ ചൂണ്ടിക്കാണിക്കപ്പെടുന്നു
മെയ് 22-നു സ്ഥാനാര്‍ഥി ലിസ്റ്റ് പ്രസിദ്ധീകരിക്കുമെന്നായിരുന്നു നേരത്തെ തീരുമാനിച്ചതെങ്കിലും വിവാദം കാരണം അതു നീണ്ടു പോകുകയാണ്.

Categories of Membership. The Federation shall have the
following Two (02) categories of members: a. Kerala Associations b. Chapters
Each category of members receives membership in the Federation according to the
provisions of these constitution and bylaws. 2. The above Two categories of
membership are defined as follows: a. Kerala Associations: A member of the
Federation in this category shall be a nonpolitical, secular and non-sectarian
Keralite/Malayalee Association in Americas which is incorporated as a
non-profit organization under the applicable federal and state laws and has
been operating at least for one year under a written constitution and/or
bylaws, with at least 50 dues paying members. b. Chapters: A member of the
Federation in this category is a subsidiary of the Federation established by
the Executive Committee as a chapter in geographical areas where the Federation
does not have a Kerala Association as a member. There shall be at least twenty-five
dues paying persons to start a chapter. The Executive Committee shall provide a
model bylaw and technical start up assistance to the chapters as needed. 3.
Admission of Members: a. All members are admitted to the Federation by the
National Committee. b. Application for membership shall be submitted to the
Secretary of the Federation in prescribed form (FOMAA MRR2016) with appropriate
membership fee. c. The Executive committee shall make a decision about the
initial applications for membership within Three (03) months from the receipt
of the application. 4. Membership Fee: a. Unless otherwise decided by the
National Committee the Biennial Membership fee for each category of members
shall be as follows: i) Kerala Associations - $100.00 (One hundred US dollars);
ii) Chapter Members - $100.00 (One hundred US dollars).
The membership shall be valid from October 01 st to September 30th of
the following year. c. Membership fees are payable in the name of FOMAA within
Ninety (90) days from the beginning of the Federation's fiscal year on October
01st . During this period, all the members of the previous year shall be
considered as fully paid members. All payments shall be in the form of an
official bank check. Personal checks are not accepted for membership purpose.
After this date, members' voting rights may be suspended until the payment is
received. The Treasurer shall send the membership fee payment notices to all
members on file and attempt to collect the fees during this period. d. Members
who had been admitted once and who missed membership fee payments during any fiscal
year, shall pay all the fees in arrears before full membership rights and
privileges can be reinstated. e. It shall be the responsibility of members to
notify the General Secretary of the Federation any changes to their names,
addresses, email IDs and cell phone numbers. Secretaries of member
organizations shall also send in the names and addresses of delegates for the
General Body meeting to reach the Secretary at least Fifteen (15) days before
the meeting. 5. Duties and Privileges of Membership: a. All members of the
Federation shall subscribe to the aims and objectives of the Federation and
shall abide by the Constitution and Bylaws of the Federation. b. Membership in
good standing in the Federation entitles a member to participate in all the
activities and privileges of the Federation. c. Representatives of all
categories of membership become eligible to attend, vote in the General Body
meetings, and to hold elected offices in the Federation in accordance with the
provisions in these constitution and bylaws.
പ്രസിഡന്റിനെ മാത്രം തെരെഞ്ഞെടുക്കുകയും പ്രസിഡന്റ് തന്നെ മറ്റുള്ള ഭാരവാഹികളെ നിയമിക്കുകയുമാണ് നല്ലത്.
